The terms for using BespokeSITE services.
These terms explain how quotes, projects, hosting, domains, SSL certificates, payments, and client responsibilities are handled when working with BespokeSITE.
Terms & Conditions
These terms apply to BespokeSITE services provided by Ben Scully. By requesting, purchasing, or using BespokeSITE services, you agree to these terms unless a separate written agreement says otherwise.
Quotes and project scope
Quotes are based on the information available at the time they are prepared. A quote may include web design, BespokeSITE CMS setup, content work, branding, hosting, domains, SSL certificates, support, or other agreed services.
Work outside the agreed scope may require a revised quote or additional charge. Examples include extra pages, design changes after approval, new functionality, third-party integrations, urgent changes, content entry, or support beyond the agreed package.
Client responsibilities
- You are responsible for supplying accurate content, images, business details, login details, legal wording, and approvals when requested.
- You must have the right to use any content, branding, photographs, logos, or other material you provide.
- You are responsible for checking and approving website content before launch.
- You must keep account credentials secure and tell us promptly if you believe access has been compromised.
Payments and invoices
Invoices must be paid by the stated due date. BespokeSITE may pause work, delay launch, restrict access, suspend services, or withhold deliverables where invoices remain unpaid.
Deposits, staged payments, renewals, hosting, domains, SSL certificates, and support fees may be payable in advance. Third-party costs may be non-refundable once ordered, registered, renewed, or activated.
Hosting, domains, and SSL certificates
Hosting, domain names, SSL certificates, email, and related services may rely on third-party providers. Availability, renewal rules, registration rules, pricing, and technical restrictions may be affected by those providers.
You are responsible for ensuring renewal invoices are paid on time. If a domain, SSL certificate, hosting service, or third-party service expires because payment or required information was not provided, the website or email service may stop working.
Approvals, launch, and changes
When you approve a design, page, feature, or launch, BespokeSITE will rely on that approval. Corrections for mistakes caused by BespokeSITE will be handled fairly, but changes to approved work may be treated as new work.
Launch dates are estimates unless confirmed in writing. Delays in supplying content, approvals, payment, access, or third-party information may affect delivery dates.
Support and maintenance
Support and maintenance are provided according to the package or agreement in place. Support does not normally include rebuilding approved work, creating new features, third-party faults, malware cleanup, content writing, or training unless agreed.
Third-party services
Websites may use third-party services such as payment providers, maps, analytics, email delivery, fonts, APIs, hosting platforms, registrars, SSL providers, plugins, or embedded content. BespokeSITE is not responsible for outages, policy changes, pricing changes, or restrictions introduced by third-party providers.
Intellectual property
Once paid in full, you may use the final approved website design, content, and visual assets produced specifically for your project for your own business. BespokeSITE retains ownership of reusable tools, code libraries, CMS software, internal systems, processes, pre-existing assets, and general know-how unless agreed otherwise in writing.
Acceptable use
You must not use BespokeSITE services for unlawful, harmful, abusive, fraudulent, spam-related, or security-compromising activity. Services may be suspended or terminated if they are used in a way that risks the platform, other customers, third-party providers, or the reputation of BespokeSITE.
Liability
BespokeSITE will use reasonable skill and care when providing services. To the fullest extent permitted by law, BespokeSITE is not responsible for indirect loss, loss of profit, loss of business, loss of data, search ranking changes, third-party outages, or issues caused by client-supplied content, third-party services, or unauthorised changes.
Cancellations and termination
Either party may end ongoing services by giving reasonable notice, subject to any agreed minimum term, renewal period, unpaid invoice, or third-party commitment. Work already completed, costs already incurred, and non-refundable third-party services may remain payable.
Legal rights
Nothing in these terms is intended to remove statutory rights that cannot legally be excluded. If any part of these terms is found to be invalid or unenforceable, the rest will continue to apply.
Updates to these terms
These terms may be updated when services, business processes, or legal requirements change. The latest version will be published on this page.
